THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS WRIT PETITION No. 23659 OF 2015 O R D E R: (per Hon'ble Sri Justice Nooty Ramamohana Rao) This Writ Petition is preferred against an order passed by the Andhra Pradesh Administrative Tribunal directing O.A.No. 3763 of 2014 preferred by the petitioner to be listed in the usual course for final hearing.

It will be appropriate to notice that in the counter-affidavit filed before the Tribunal in O.A.No. 3763 of 2014, the District Medical & Health Officer, Nizamabad, who swore to the counter-affidavit, in paragraph 6(e), has made a statement that the 2nd respondent is taking all necessary steps to release the pension and pensionary benefits subject to approval and submission of all records and details, which are necessary for such a purpose. This counter-affidavit was sworn to on 04.09.2014 and ten months' period has already elapsed there from. The grievance of the petitioner is that no pension, not even provisional pension, and no other terminal benefits have been settled and paid to him. Therefore, we feel that a prima facie case is made out for hearing the O.A. on out of turn basis. In fact, the statute, by which the Andhra Pradesh Administrative Tribunal has been created, considers it desirable that the Tribunal should decide the cases in six months' period. Claims relating to pension and pensionary benefits must therefore, receive priority.

In this view of the matter, we hope and trust that the Andhra Pradesh Administrative Tribunal will fix as expeditious date as is possible for final hearing of the O.A., in view of the pleadings being complete therein and decide the main O.A. at the earliest. With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous applications, if any shall also stand disposed of.
