This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, seeking to quash the proceedings in C.C.No.67 of 2017 on the file of the II Special Magistrate, Visakhapatnam. 2 .

Heard the learned counsel for the petitioner/ accused, learned Assistant Public Prosecutor representing the 2nd respondent-State and perused the record.

Having argued the matter at length and contended that there was no valid service of notice on the petitioner/ accused and that there was no demand of cheque amount specifically in the notice, when the dictation of the order commenced, the learned counsel for the petitioner/ accused sought permission to withdraw the Criminal Petition. In view of the same, without expressing any opinion on the merits of the matter, permission, as sought for, is accorded.

Accordingly, the Criminal Petition is dismissed as withdrawn.
