The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in not issuing New Pattadar Pass Book to the petitioner though issued to others as arbitrary illegal discriminatory and consequently direct the respondents to issue New Pattadar Pass Book to the petitioner forthwith in respect of land to an extent of Ac 400 Guntas in Survey No 107/32 situated at Mellor Village Yeldurthy Mandal Medak District and pass and to grant such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."
Perusal of the record reflects that the name of the petitioner has already been entered in Form-IB under the Telangana Rights in Land and Pattadar Passbooks Act, 1971, (for brevity 'the Act of 1971') in relation to the subject land. Further, the petitioner made an application on 11.08.2018 to the Tahsildar, Yeldurthy Mandal, Medak District, seeking issuance of the new pattadar passbooks and the endorsement made thereon evidences receipt of the said application by the Tahsildar's office. Having received such application, it is not open to the Tahsildar, Yeldurthy Mandal, Medak District, to remain somnolent. The Writ Petition is accordingly disposed of directing the Tahsildar, Yeldurthy Mandal, Medak District, to take appropriate action on the petitioner's application dated 11.08.
2018 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
