THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5280 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused in C.C.No.884 of 2015 pending on the file of II Additional Judicial Magistrate of First Class, Khammam arising out of Crime No.44 of 2015 registered for the offence punishable under Section 30 of Indian Arms Act read with Section 188 IPC.

Heard and perused the material on record.

It is evident from the material on record that the petitioner/ accused was charged for the offence punishable under Section 30 of the Indian Arms Act for being violated the rules and regulations as per the Indian Arms Act in informing about possession of pistol as well as using the same as per the licence though he is having valid licence. As he violated the said rules, a case was registered under Section 30 of Indian Arms Act against him, which was taken on file as C.C.No.884 of 2015 pending before the competent court. Whether the petitioner/accused has really violated the rules of the said Act is a matter to be adjudicated by the competent court after a due trial in which case this Court cannot interfere with. Hence, the criminal petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any, pending

shall stand closed.
