Today when this matter is taken up, the learned counsel for the petitioner/ accused fairly conceded that instead of mentioning the correct crime number and penal provisions as contained in the First Information Report, some other crime number and penal provisions were mentioned in the Memorandum of Criminal Petition.

In view of the same, without expressing any view on the merits of the matter, this Criminal Petition is dismissed giving liberty to the petitioner/ accused to file a fresh application. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
