HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TRANSFER CIVIL MISCELLANEOUS PETITION No.315 of 2014 ORDER:
This petition is filed under Section 24 C.P.C., to withdraw MVOP No.813 of 2013 from the file of Motor Accidents Claims Tribunal-cum-Principal District Judge, Guntur and transfer the same to the file of Motor Accidents Claims Tribunal-cum-I Additional District Judge, Ongole for trial and disposal along with O.P.No.337 of 2013 in accordance with law.
2. Heard the learned counsel for both the parties.
3. A perusal of the record reveals that MVOP No.813 of 2013 is filed by the wife of the deceased claiming compensation. As per the averments made in MVOP No.813 of 2013, due to non-cooperation of the in-laws, the petitioner has shown her in-laws as respondents. O.P. No.337 of 2013 is filed by the parents of the deceased without showing the wife and son of the deceased as respondents. MVOP No.813 of 2013 is more comprehensive than O.P. No.337 of 2013.
4. At the time of arguments, learned counsel for the petitioner and learned counsel for the respondent, in one voice, submitted that O.P. No.337 of 2013 from the file of Motor Accidents Claims Tribunal-cum-I Additional District Judge, Ongole may be transferred to the file of Motor Accidents Claims Tribunal-cum-Principal District Judge, Guntur.
5. In view of the above submission, the Transfer CMP is allowed. O.P. No.337 of 2013 is withdrawn from the file of Motor Accidents Claims Tribunal-cum-I Additional District Judge, Ongole and transferred to the file of Motor Accidents Claims Tribunalcum-Principal District Judge, Guntur for trial and disposal along with MVOP No.813 of 2013 in accordance with law.
