THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40728 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of 2nd respondent in registering the Crime No.471 of 2016, as illegal and arbitrary and to quash the same. The case of the petitioner is that the 3rd respondent, who is the father of the victim girl aged about 17 years, lodged the present complaint against the petitioner alleging that the petitioner, who is working as Maths lecturer, used to harass his daughter and used to send text messages to her mobile number and on 11.10.2016, when the 3rd respondent's family went to Kalimatha Temple at Uppuguda along with his family, the petitioner tried to tease his daughter. Basing on the said complaint, the 2nd respondent registered the same as Crime No.471 of 2016.

The victim girl, B. Vaishnavi, and the petitioner are present before the Court. In view of the fact that the victim girl informed the Court that in view of the apologies rendered by the petitioner as well as the intervention of the elders of the petitioner, the victim girl is not inclined to proceed further against the petitioner and the victim girl is inclined to compromise the issue.

In view of the compromise entered into between the parties and taking into consideration the future of the victim girl, the proceedings in Crime No.471 of 2016, on the file of the Chatrinaka Police Station, Hyderabad, dated 11.10.2016, are hereby quashed. Accordingly, the Writ Petition is allowed. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 1st December, 2016 KL
