THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28304 of 2016 ORDER:

The petitioner is working as Field Assistant under the Mahatma Gandhi National Rural Employment Guarantee Scheme in the office of the fourth respondent. While so, an order of suspension was issued on 15.07.2016 suspending the petitioner on the ground that he did not distribute the plants in the Harita Haram Programme and was negligent by throwing them away. He was issued an order of suspension along with show cause notice asking him to submit explanation within seven days. Challenging the suspension order, the present writ petition is filed.

2. In view of the opportunity given by the third respondent, this Court is not inclined to interfere with the impugned order dated 15.07.2016, but directs the third respondent to complete the enquiry against the petitioner within a period of four weeks from the date of receipt of a copy of this order. In view of the opportunity given to the petitioner, he is at liberty to submit his explanation on or before 30.08.2016.

3. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
