Petitioner complains against the inaction in considering and disposing of representations dated 06.07.2016 and 18.10.2016 as illegal, arbitrary and contrary to G.O.Ms.No.4 Consumer Affairs, Food and Civil Supplies (CS-1) Department dated 28.02.2014. 2.

The case of the petitioner is that his father was a Kerosene Hawker vide license No.1006-1007 of Sadashivapuram and Anasagaram villages, Nelakondapally Mandal, Khammam District and had authorization up to 31.03.2017. On 29.04.2016, it is averred, petitioner's father died. According to the petitioner, he has been representing for considering his case for appointment as Kerosene Hawker and the latest representation was made on 18.10.2016 and non-consideration in terms of G.O.Ms.No.4 dated 28.02.2014 is arbitrary and unconstitutional. Hence, the writ petition. 3.

Learned Assistant Government Pleader, on instructions, submits that the respondents, in fact, are considering the cases of eligible candidates for appointment as Kerosene Hawker subject to the candidates satisfying the eligibility criteria and also that no permanent appointment is already made. He submits that the representation of the petitioner will be considered and disposed of within eight weeks from the date of receipt of a copy of this order. 4.

The statement is placed on record and accepted.

The writ petition is disposed of by directing respondents 3 and 4 to consider the petitioner's representations dated 06.07.2016 and 18.10.2016 within eight (8) weeks from the date of receipt of a copy of this order in terms of G.O.Ms.No.4 dated 28.02.2014 and communicate the decision to the petitioner.

As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
