HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4232 of 2019 ORDER:

The prayer of the petitioners in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of Respondent Nos.3 and 4 in not issuing new pattadar pass books to the petitioners in respect of lands owned by them at Jakkapur Village, Sirpur (T) Mandal, Adilabad District, presently Kumaram Bheem-Asifabad District, as illegal, arbitrary and violative of Articles 14, 21 and 300A of Constitution of India and to consequently direct the Respondent Nos.3 and to forthwith consider the representation made by petitioners on 11.02.2019 and issue new pattadar pass books to the petitioners, award costs and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that all the petitioners were issued pattadar pass books under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. They submitted an application dated 11.02.2019 to the Tahsildar, Sirpur (T) Mandal, Kumaram Bheem-Asifabad District, seeking issuance of new pattadar pass books. As no action was taken thereupon under communication to them, the petitioners are before this Court. Perusal of the application dated 11.02.2019, a copy of which is placed before this Court, would demonstrate that the same was received by the Tahsildar, Sirpur (T) Mandal, Kumaram BheemAsifabad District. Having received such an application, it is not open to the Tahsildar concerned to remain somnolent.

SK, J WP.No.4232 of 2019 Dt:28.02.2019 The Writ Petition is accordingly disposed of directing the Tahsildar, Sirpur (T) Mandal, Kumaram Bheem-Asifabad District, to take appropriate action upon the petitioners' application dated 11.02.2019 in accordance with the due procedure expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
