Heard the learned counsel for the petitioners and the learned Government Pleader for Panchayat Raj appearing for the respondent Nos.1 to 3.

Petitioner has questioned the order dt.25-08-2014 issued by 2nd respondent placing the petitioner under suspension pending enquiry alleging certain irregularities committed by him mentioned therein.

Learned counsel for the petitioner contends that though the petitioner was suspended on 25-08-2014 and a charge memo was issued, enquiry is not yet completed. He further contended that petitioner's subsistence allowance which should have been enhanced after first six months to 75% as per Rule 8.2 (vi) of the Terms and Conditions of Employment of Society for Elimination of Rural Poverty (SERP) Employees-2009 has not been so enhanced. 4.

Learned Government Pleader for Panchayat Raj appearing for respondent Nos.1 to 3 states that the enquiry against the petitioner would be completed within a period of four months from the date of receipt of a copy of this order.

Therefore, the Writ Petition is disposed of without expressing any opinion on the merits of the contentions of the

MSR,J W.P.No.36807 of 2016 petitioner as regards his innocence or guilt of the charges framed against him by directing the respondents to complete the disciplinary enquiry against the petitioner within four months from the date of receipt of a copy of this order. Further, the respondents shall also release 75% of his petitioner's remuneration, which he is entitled to under Rule 8.2 (vi) of the (SERP) Employees-2009 framed by 2nd respondent, along with arrears within four weeks from the date of receipt of a copy of this order.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
