THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3211 of 2015 ORDER:
1. This Criminal Revision Case is filed by the petitioners-A2 and A3 aggrieved by the order dated 3.12.2015 passed in Crl.M.P.No.2029 of 2015 in C.C. No.291 of 2013 by the Additional Junior Civil Judge, Rayachoty.
2. The petitioners are alleged to have committed the offence punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. The petitioners along with another accusedA6 filed the above Crl.M.P. seeking to discharge them. The trial Court dismissed the above Crl.M.P. insofar as the petitioners are concerned. Therefore, they filed the present revision.
3. Heard and perused the material available on record.
4. It is alleged that the de facto complainant, who is the daughter-inlaw of the petitioners, resided at their house, when A1 left to Maldives for his job and at that time, the petitioners subjected her to harassment. The truth or otherwise of the said allegations can be elicited only after full fledged trial as rightly observed by the trial Court. Therefore, this Court is not inclined to interfere with the order under revision.
5. At this stage, the learned Counsel for the petitioners has prayed to dispense with the presence of the petitioners before the trial Court.
6. Accordingly, the Criminal Revision Case is dismissed. However, the presence of the petitioners before the trial Court is dispensed with except on the date of their examination on the charges and on the date of their examination under Section 313 Cr.P.C.
