This criminal petition is filed under Section 480 &483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused seeking their enlargement on bail in connection with Crime No.230 of 2025 of Noothankal Police Station, Suryapet District.The offences alleged against the petitioners are under Sections 103, 115(2), 118(1), 191(2) (3) r/w.190 of Bharatiya Nyaya Sanhita (for short 'BNS').

The case of the prosecution is that on 10.12.2025 at about 02:00 hours, the complainant Smt. Uppula Lingamma, wife of Uppula Mallaiah, gave a complaint to the police stating that on 09.12.2025 at about 11:00 hours during the night, her husband Uppula Mallaiah, along with villagers Karingula Mahesh, Karingula Shekar, and Uppula Pavan, was sitting near the party symbol blocks (party dimmelu) in their village and discussing. At that time, villagers namely Uppula Sathish, Korvi Gangaiah, Veeraboina Sathish, Uppula Gangaiah, Uppula Yalamanchi came to the spot and abused her husband in filthy language. Thereafter, the accused pushed her husband on to the road and beat him. Accused Uppula Sathish and Korvi Gangaiah attempted to kill him by attacking him with a stone and a stick, hitting him on the head.

As a result, he fell on the road and sustained bleeding injuries on his head. Meanwhile, villagers Korvi Naresh and Korvi Ganesh and some others tried to rescue the complainant's husband from their clutches, but the accused also beat them with sticks and hands. Hence, the complainant requested the police to take necessary action against the accused basing on which, the police registered the case against the accused for the above offences.

Heard Sri Angothu Nehru, learned counsel appearing for the petitioners and Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioners is that petitioners are innocent of the said allegations and they are no way connected with the alleged offences. The investigation is almost completed. Petitioners are in jail from 10.12.2025. The parents of the petitioners are old aged and they are dependents on them. Petitioners would abide any conditions that may be imposed by this Court and prayed this Court to grant bail to the petitioners.

On the other hand, learned Assistant Public Prosecutor opposed bail stating that the allegation against the petitioners is serious in nature. A.1 beat with cot wood and A.2 beat with a stone on the injured head as a result he died. When Lw.3, 4, 8 and 9 tried to rescue the deceased, all the accused beat them also. Investigation is also still pending. The post mortem examination report of the deceased and the medical certificates of the petitioners are yet to be received. The petitioners in this case also suffered injuries in the said incident. Hence, petitioners are not entitled for bail and prayed to dismiss this petition.

Having regard to rival submissions made, and on perusing the material placed on record, it is noted that the petitioners are in jail since 10.12.2025. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 19 witnesses have been examined. Considering the facts and circumstances of the case and the incarceration period of the petitioners, and keeping in mind the progress in investigation, this Court deems it fit to grant bail to the petitioners, subject to the following conditions: i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, at Thungathuthy, Suryapet District.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
