HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4868 of 2015 O R D E R:

1. This petition is filed by the petitioners-accused seeking to modify the order dated 29.5.2015 passed in Crl.M.P.No.704 of 2015 in Crl.M.P.No.559 of 2015 in Crime No.17 of 2015 by the II Additional Sessions Judge, Kadapa at Proddatur.

2. It is stated that while granting bail to the petitioners vide order dated 30.4.2015 in Crl.M.P.No.559 of 2015, the learned Additional Sessions Judge imposed the following conditions:

"The petitioners shall appear before the S.H.O I Town P.S. Kadapa on every day between 5 P.M., and 6 P.M. and they should not leave Kadapa city and they should not enter into the limits of Kondapuram village till further orders." Then, the petitioners filed the above Crl.M.P.No.704 of 2015 seeking to relax the above conditions. The learned Additional Sessions Judge partly allowed Crl.M.P.No.704 of 2015 directing the petitioners to appear before the S.H.O., Kadapa I Town P.S., on every Tuesday and Friday between 5 P.M., and 6 P.M. instead of every day and directing them to be available within the limits of Kadapa city and further directing them not to enter into the limits of Kondapuram village. Aggrieved by the same, the petitioners approached this Court.

3. Learned Counsel for the petitioners submitted that the petitioners are agriculturists and in this season, they have to attend for agricultural operations and therefore, the above conditions may be relaxed.

4. Considering the above facts and circumstances of the case, this Criminal Petition is disposed of with the following direction:

"The above conditions imposed by the learned Additional Sessions Judge Crl.M.P.No.704 of 2015 are relaxed subject to the condition of the petitioners complying with the same for a period of one month i.e.,

till 17.7.2015."
