HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.4261 of 2020 ORDER:

Heard the learned counsel for the petitioners as well as the learned Standing counsel appearing for the 3rd respondent - Corporation.

The prayer sought in the writ petition is as under: "... to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring inaction of the respondents No.2 and 3 herein in taking any steps in pursuance to 2nd petitioner's representation dated 12.03.2019 and 1st petitioner's representation dated 24.01.2020 in response to the final notice No.KMC/A1/9378/2019-20 dated 04.01.2020 issued on the name of the 2nd petitioner herein by the 3rd respondent i.e., Commissioner, Khammam Municipal Corporation, in respect of payment of property tax for the period 2019-2020 to a sum of Rs.2,59,108/- as against H.No.

9-3-81/2 located at Station Road, Khammam, as illegal, arbitrary, unconstitutional, whimsical, irrational, malafide, unreasonable and contrary to the relevant rules of property tax assessment and to consequently direct the respondents No.2 and 3 herein to forthwith consider petitioners representations dated 12.03.2019 and 24.01.2020 and forthwith review the unilateral assessment made vide Final Notice No.KMC/A1/9378/2019-20 dated 04.01.2020 in respect of property bearing H.No.9-3-81/2 located at Station Road, Khammam issued on the name of the 2nd petitioner herein by the 3rd respondent."

Learned counsel for the petitioners submits that in view of the unilateral assessment made in Final Notice No.KMC/A1/9378/2019-20 dated 04.01.2020 in respect of the property bearing house No.9-3-81/2 located at Station Road, Khammam, the petitioners made representations dated 12.03.2019 and 24.01.2020 since the revision of property tax is illogical. Ms. M. Bhagyasri, learned Standing counsel appearing for the 3rd respondent - Corporation, on instructions, submits that the 3rd

respondent will consider the representations given by the petitioners and pass appropriate orders.

Taking the above said submission into consideration, the writ petition is disposed of, directing the 3rd respondent - Corporation to consider the representations dated 12.03.2019 and 24.01.2020 submitted by the petitioners and pass appropriate orders as per law within a period of six (6) weeks from the date of receipt of a copy of this order. No order as to costs.
