HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No. 22070 of 2015 Order: (Per Hon'ble Sri Justice S.V. Bhatt) Petitioner prays for a Mandamus to declare the inaction of the 4th respondent in mutating the name of the petitioner for the house property bearing No. 4-86/5/B at Cheppur Village, Armoor Mandal, Nizamabad District, in property register maintained by Grama Panchayat, as illegal and arbitrary. The case, briefly stated is that the house bearing No. 4-86/5/B stands in the name of Malyala Yelliah, petitioner's husband and he died on 5.3.2006. Petitioner has applied for mutation of her name in the Property Register maintained by the 4th respondent. The 4th respondent, through notice dated 9.2.

2015 has called upon the petitioner to furnish the Death Certificate of her husband and also the Family Member Certificate issued by the Tahsildar to take up the application for change of name in property register. The case of the petitioner is that both these requirements are made good by the petitioner and in spite of due compliance of objections, the 4th respondent has not effected changes to the subject property in the Register. Hence, the writ petition complaining inaction.

Heard learned counsel for the petitioner and the learned Government Pleader appearing for the 2nd respondent.

The prayer is one of inaction against the 4th respondent. Having perused the material available on record, we are satisfied that the

following order would met the fact situation of the case. The 2nd respondent, within ten days from the date of receipt of a copy of this order, issues appropriate directions to 4th respondent to look into the application of the petitioner filed to mutate her name for the property bearing No. 4-86/5/B at Cheppur Village, Armoor Mandal, Nizamabad District, consider the documents already filed by the petitioner and appropriate orders are passed within a period of four weeks from the date of issuance of such direction. The 2nd respondent issues appropriate directions as above.

The writ petition is disposed of as indicated above. Consequently, pending miscellaneous applications shall also stand closed. No costs.
