JUDGMENT:- This Court, on 29.06.2016, made the following order: "As appeared none on behalf of the petitioners at 4.00 p.m., the matter is directed to be listed on 05.07.2016 under the caption "for dismissal". However, at about 4.29 p.m., the learned counsel appearing on behalf of the respondents pointed out that appeared none on behalf of the petitioners on 17.06.2016 and this Court directed the matter to be listed next week under the caption "for dismissal". But, today, the matter is listed under the caption "final hearing" instead of "for dismissal". In view of the above, though the matter should have been listed under the caption "for dismissal, however, appeared none on behalf of the petitioners on two consecutive dates. Therefore, let the matter be listed under the caption "for dismissal" on 05.07.2016."

On 05.07.2016, at the request of the learned counsel for the appellants, the matter was directed to be listed after two weeks. Today, when the matter is taken up for hearing, nobody has appeared on behalf of the appellants nor is made any representation on their behalf. From the above facts, it appears that the appellants are not interested in prosecuting the matter any further. Hence, this Appeal Suit is dismissed for nonprosecution. No order as to costs. As a sequel to the dismissal of the Appeal Suit, Miscellaneous Petitions, if any pending, shall stand

disposed of as infructuous.
