THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26314 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the impugned provisional notice dated 25.02.2016 issued by the second respondent, as illegal and arbitrary.

2. Heard Sri P.Narasimha Rao, the learned counsel for the petitioner and Sri M.Ravindra, the learned Standing Counsel for the respondents.

3. A perusal of the record reveals that the petitioner is a Low Tension Power Supply Category - 3 Consumer. While so, on 25.02.2016 the second respondent issued a notice directing the petitioner to pay an amount of Rs.2,84,067/- as if there is a defect in the meter in respect of S.C.No.86156 Category 3.

4. The learned counsel for the petitioner submitted that in pursuance of the notice dated 25.02.2016, the petitioner paid an amount of Rs.1,42,050/-. The petitioner submitted a representation to the third respondent on 30.06.2016 for conversion of Low Tension Category to High Tension Category if necessary.

5. At the time of argument, the learned counsel for the petitioner submitted that the respondents may be directed to dispose of the representation of the petitioner dated 30.06.2016.

6. The learned Standing Counsel for the respondents submitted that the respondents have no objection for disposal of the representation of the petitioner.

7. Having regard to the facts and circumstances of the case, the third respondent is hereby directed to dispose of the representation of the petitioner dated 30.06.2016 in the light of the provisions of the

Electricity Act, 2003 as expeditiously as possible. Respondent Nos.2 and 3 are hereby directed not to disconnect the power supply to the Service Connection No.86156 till disposal of the said representation.

8. With the above direction, the Writ Petition is disposed of. No costs.

9. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
