HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4220 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly the 3rd respondent herein in not mutating the concerned revenue records by way of incorporating the name of the petitioner and not issuing the e-Pattadar Passbooks and title deeds in respect of land admeasuring Acs.10.00 Gts under Sy.No.57/32 situated at Ghanpur Village, Marpally Mandal, Ranga Reddy District, on his application dated 30.11.

2017 as illegal, arbitrary, unjust, unconstitutional and in violation of principles of natural justice and also contrary to the provisions of Telangana Rights in Land and Pattadar Passbooks Act, 1971, and consequently direct the respondents to consider the application of the petitioner dated 30.11.2017 for mutation in respect of the subject land after following the procedure strictly in accordance with law and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioner made an application in the prescribed format in Form VIA under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The endorsement made on the said application reflects that the office of the Tahsildar, Marpally Mandal, Ranga Reddy District, received the same on 30.11.2017.

Having received such an application, it is not open to the Tahsildar Marpally Mandal, Ranga Reddy District, to remain somnolent.

The Writ Petition is accordingly disposed of directing the Tahsildar, Marpally Mandal, Ranga Reddy District, to take appropriate action upon the petitioner's application in Form VIA in

SK, J WP.No.4220 of 2019 Dt:28.02.2019 accordance with the due procedure expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
