HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.454 of 2014 ORDER:

Heard learned counsel appearing for the petitioner and learned Public Prosecutor.

Aggrieved by the order dated 12.07.2013 passed in C.C. No.304 of 2009 on the file of the I Additional Judicial Magistrate of First Class, Khammam, wherein an application filed by the Public Prosecutor is allowed directing recall of witnesses, the present Revision is filed. The only ground raised by the learned counsel for the petitioner is that no opportunity was given to him while passing the docket order dated 12.07.2013.

On the other hand, the order itself discloses that the said order was passed in the presence of learned A.P.P., for State and Sri R.Venkat, learned counsel for the Accused 1 to 4. Therefore, it cannot be said that no opportunity was given to the petitioner while passing the said order. In view of the above, I see no reason to interfere with the order passed by the trial court. Accordingly, the Criminal Revision is dismissed. As a sequel to it, miscellaneous petitions pending if any in this Criminal Revision, shall stand closed.
