Heard the learned counsel for the petitioners and the learned counsel for respondents 6 to 17.

The 1st petitioner claims that he is owner and possessor of land to an extent of Ac.1.12 gts in Sy.No.90/AA and Ac.0.08 gts in Sy.No.91 of Tattiannarama village, Hayathnagar Mandal, Ranga Reddy District. The petitioners jointly claim that they are owners and possessors of land to an extent of Ac.3.86 gts in Sy.No.91 of Tattiannaram village, Hayathnagar Mandal, Ranga Reddy District. So far as the land of the 1st petitioner is concerned, the Revenue Divisional Officer issued pattedar passbook. With regard to land in Sy.No.91, their application for mutation of land in their favour is pending before the 1st respondent. There was some delay in getting

mutation due to pendency of proceedings before Land Reforms Appellate Tribunal in L.R.A.No.15 of 2000. They filed objections in the said proceedings. By order dated 08.06.2004, the Land Reforms Appellate Tribunal released their land from the surrender proceedings of the third party. When the 1st respondent passed orders on 15.04.2005 under the provisions of A.P.Rights in Lands and Patterdar Passbooks Act, 1971 in favour of respondents 2 and 3, the present writ petition was filed. The learned counsel for the respondents brought to the notice of this court the decision of this Court in Taurus Homes (P) Ltd. V. Joint Collector No.1, Ranga Reddy Dist., wherein, the learned single Judge of this Court set aside the proceedings of the 1st respondent herein dated 15.04.2005 and confirmed by the Joint Collector on 12.12.2008. He remanded the matter to the 1st respondent herein for fresh consideration and disposal. It is submitted that the proceedings are pending before the 1st respondent.

In the circumstances, all the contentions of the parties are left open and the present Writ Petition is allowed, in view of the orders of the learned single Judge of this Court dated 08.04.2009 in W.P.No.4989 of 2009.
