THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37726 of 2016 ORDER:

This Writ Petition, under Article 226 of Constitution of India, is filed seeking the following relief:

"....declaring the inaction on the part of the respondent No.4 in releasing the salary, ESI, EPF, Service Tax and Agency Commission for the services of the workers of the petitioner availed by the respondents No.4 to 10 as arbitrary, illegal and violative of the fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution and consequently direct the respondent No.4 to pay salary, ESI, EPF, Service Tax and Agency Commission for the services of the workers of the petitioner availed by the respondents No.4 to 10 for the month of September, 2016 and also to continue to release the same as long as the services of the workers of the petitioner are availed by the respondents Nos.4 to 10."

Heard and perused the material available on record. 3.

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 4th respondent to dispose of the representation, dated 18.10.2016, submitted by the petitioner.

Having regard to the facts and circumstances of the case and submission of learned counsel for the petitioner and without going into the merits of the case the Writ Petition is disposed of directing the 4th respondent to dispose of the representation, dated 18.10.2016, submitted by the petitioner within a period of fifteen (15) days from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
