HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.4240 of 2020 ORDER :

This Writ Petition is filed seeking Mandamus declaring the action of the respondent No.1 - Revenue Divisional Officer, Gadwal Town and Mandal, Jogulamba Gadwal District, in not disposing of Case No.B/954/2019, dt.11.07.2019 in pursuance of the application filed by the petitioners on 08.04.2019 relating to issuance of Occupancy Rights Certificate on the land admeasuring to an extent of Acs.9-25 guntas in Sy.No.309, situated at Maddelabanda Village, Maldakal Mandal, Jogulamba Gadwal District, as arbitrary and illegal.

Heard learned counsel for the petitioners and the learned Government Pleader for Revenue.

The case of the petitioners is that the petitioners have made an application in Form No.1 on 08.04.2019 requesting respondent No.1 - Revenue Divisional Officer, Gadwal Town and Mandal, for grant of Occupancy Rights Certificate in respect of the said land under the Inams Abolition Act by enclosing necessary documents. Pursuant to the Notice issued by respondent No.1 under Form-2 directing the petitioners to appear before him on 17.06.2019, the petitioners also appeared before respondent No.1 and a report

ARR,J W.P.No.4240 of 2020 was also called for from the Assistant Survey of Land Records and Endowments. Inspite of the same, the application of the petitioners is not being disposed of.

The learned Assistant Government Pleader for Revenue submits that though they addressed a letter recently, they have not received any report from the Assistant Survey of Land Records and Endowments and as and when they receive such a report, they will consider the application dt.08.04.2019 of the petitioners and pass appropriate orders. It is to be noted that since application dt.08.04.2019 has been made by the petitioners almost six months back, it is for respondent No.1 to consider the same and take appropriate action in accordance with law. Therefore, respondent No.1 is directed to consider application dt.08.04.2019 of the petitioners and take appropriate action on the same in accordance with law within a period of four

(4) months from the date of receipt of a copy of this order. With the above observations and direction, this writ petition is disposed of. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
