Sri. Murali Krishna Reddy Tummuru v. State Of Telangana
THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.4352 of 2019 ORDER:
The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an order or writ, one more particularly in the nature for writ of mandamus declaring the inaction of the Respondents No.2 and 3 in not taking steps of Petitioner's application for survey and subdivision of the land situated in Sy.No.179 of Gajularamaram Village, Quthbullapur Mandal and Municipality, Ranga Reddy District dated 30.08.2018, as being illegal and arbitrary and consequently directing the Respondents No.2 and 3 to forthwith take steps for conducting survey and demarcation of the Petitioner's land and pass such other order or orders as this Hon'ble Court deems fit and proper in the interest of justice.'
Perusal of the record demonstrates that the petitioner made an application in the prescribed format by way of a F-line petition seeking survey and sub-division of the subject land by paying the requisite fee. The F-line petition is dated 13.08.2018 and the authorities undertook to take appropriate necessary action thereon within forty-five working days. The complaint of the petitioner presently is that despite the aforestated time frame, no steps have been taken till date. It is not open to the revenue authorities to receive an application in the prescribed format and remain somnolent.
The writ petition is accordingly disposed of directing the Mandal Surveyor, Medchal-Malkajgiri Mandal, to take appropriate action upon the petitioner's F-line petition dated 13.08.2018 expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:05.03.2019 GJ
