THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.3544 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home (AP).

When the matter is taken up, the learned Government Pleader has placed on record the written instructions, dated 07.02.2018, furnished by the Sub Inspector of Police, Jarugumilli Police Station, Prakasam District, wherein it is submitted that, on a private complaint filed by the petitioner herein on the file of the learned Additional Munsif Magistrate, Kandukur, a case in Cr.No.13/2012 was registered and, after completion of investigation, the then Investigating Officer obtained permission from the SubDivisional Police Officer, Ongole to refer the complaint as 'false'.

Subsequently permission was accorded vide proceedings C.No.167/Refer/SDPO-)/2013, dated 28.03.2017. It is further submitted that, though the Investigating Officer obtained permission for referring the case as 'false', final reports could not be filed by the concerned Court and the Sub Inspector of Police further assures that the final reports would be filed within a fortnight by following due procedure.

In view of the above, the Writ Petition stands disposed of, by placing on record the above written instructions.

Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
