THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No. 6607 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner with the following relief : " to declare the action of respondent No.4 in interfering with the petitioner's peaceful possession and enjoyment of the land to an extent of Ac.0.20 guntas in Sy.No.28 of Wdaddepalli Vilage and Mandal, Mahabubnagar District, which was purchased by the petitioner as long as in the year 1998 for a valid sale consideration and during the pendency of the representation with respondent NO.2 seeking to assign the said land on payment of prevalent market value as the said land is not useful for any public purpose and the same is catering the needs of the petitioner for his agricultural operations of the land owned by him in terms of G.O.Ms.No.1407, Revenue Department dt. 24.07.
1958 as illegal, arbitrary and is in violation of principles of natural justice and fair play apart from being in violation of Article 21 and 300-A of the Constitution of India, and consequently direct the respondents not to interfere with the possession and enjoyment of the aforesaid land." The main assertion made by the petitioner is that he purchased the land of an extent of Ac .0.20 guntas in Sy.No.28 of Wdaddepalli village and Mandal, Mahabubnagar District, from Smt B. Ragavenamma w/ o B. Narasimhaiah under registered sale in the year 1998. While the matter stood thus, respondent No.4 issued Notice dt. 21.07.2015 alleging that the land purchased by the petitioner is assigned land and the said transaction is hit by the provisions of Andhra Pradesh Assigned Lands ( POT) Act.
Thereupon, the petitioner submitted a representation to respondent No.2 on 02.02.2016, which is now pending and in view of the pendency of the representation, the learned Government Pleader for Revenue appearing for the State of Telangana, requested this Court to direct respondent No.2 to dispose of the representation of the petitioner dt. 02.02.
maintaining status quo as on today in terms of the interim Order passed by this Court on 01.03.2016.
In view of the request made by the learned Government Pleader and considering the facts and circumstances of the case, respondent No.2 is directed to dispose of the representation submitted by the petitioner on 02.02.2016, by reasoned order in accordance with law within two months from the date of rec eipt of a copy of this Order. Further, both parties are directed to maintain status quo as on today in terms of the interim order passed by this Court on 01.03.2016. With the above observation, this Writ Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
