THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.1506 of 2003 ORDER: (Per the Hon'ble Sri Justice Ramesh Ranganathan) Both Sri K.V.Satyanarayana, learned counsel for the petitioner, and Sri M.V.J.K.Kumar, learned Senior Standing Counsel for Central Excise, would agree that, as the substantive appeal preferred against the impugned order is pending before the appellate authority, it would suffice if the writ petition were to be disposed of directing that the appeal be disposed of at an early date.
We consider it appropriate, in such circumstances, to direct the appellate authority to decide the appeal with utmost expedition, and in any event not later than two months from the date of receipt of a copy of this order, after giving the petitioner an opportunity of being heard. The writ petition stands disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
