HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 1284 of 2022 O R D E R:

This Criminal Petition under Section 439 (1)(b) read with Section 482 Cr.P.C. is filed to relax the condition imposed by the learned I Additional Metropolitan Sessions Judge, Hyderabad vide order dated 29.01.2021 in Crl.M.P. No. 181 of 2021 in Crime No. 35 of 2020 on the file of Prohibition & Excise Police Station, Secunderabad.

The learned Magistrate by the aforesaid order granted bail to the petitioner. While granting bail, the petitioner was directed to appear before the SHO concerned on every first Sunday till filing of charge-sheet and cooperate with the investigating agency as and when required.

Learned counsel for the petitioner Sri Mohd.

Muzaferullah Khan submits that from the last one year, the petitioner has been complying with the condition and as it is causing great hardship and inconvenience, hence, the said condition may be relaxed.

The offence alleged against the petitioner is under the provisions of the Narcotic Drugs and Psychotropic Substances Act. In fact, this Court while granting bail under the NDPS Act has been imposing a condition that the accused shall appear before the police once in a week till the trial is completed. In view of the same, this Court is not inclined to relax the condition imposed by the learned I Additional Metropolitan Sessions Judge, Hyderabad.
