HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17386 OF 2009 ORDER:

The writ petition is filed questioning the recovery proceedings dated 19.06.2009, issued by the 2nd respondent on account of the common order dated 02.12.2008, passed by this Court in W.P.No.28433 of 2007 and batch.

It is the case of the petitioners that they had joined in the services of the respondents-Primary Agricultural Cooperative Societies as paid Secretaries and they were paid the salaries at the rate of Rs.7,000/- per month pursuant to G.O.Ms.Nos.226 (Coop.-VI) Dept, dated 29.06.2005 and 247 Agrl.& Coopn. (Coop._VI) Dept, dated 2.11.2006 as they had completed the requisite service. However, on account of the common order dated 02.12.2008, passed by this Court in W.P.No.28433 of 2007 and batch, recovery proceedings were initiated by the respondents-authorities. Hence, the present writ petition.

Today, when the matter is taken up for hearing, Smt Bobba Vijalakshmi, learned counsel for the petitioners submits that all the petitioners were retired from service and the entire amount was recovered from the salary of the 1st petitioner and she has no instructions from the petitioners 2 and 3.

In that view of the matter, learned counsel for the petitioners fairly submits that the writ petition may be closed giving liberty to the petitioners to question the recoveries already made in the event they are aggrieved. In the light of the submissions made by the learned counsel for the petitioners without expressing any opinion the writ petition is closed giving liberty to the petitioners to challenge the recoveries made, if any, if they are otherwise aggrieved. No order as to costs. Miscellaneous Petitions pending, if any, in this writ petition shall

also stand closed.
