THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 355 OF 2016 O R D E R:

This Company Petition is filed seeking winding up of the respondent Company for non-payment of the amounts due and payable to the tune of Rs.7,73,769/- to the petitioner Company. As there was no representation on behalf of the respondent Company on several occasions, the Company Petition was admitted on 03.07.2018 and the petitioner was permitted to carry out advertisement in Andhra Jyothi, Telugu and Business Standard, English daily newspapers, in Hyderabad Editions, calling for objections from the creditors either to support or oppose the Company Petition. Thereafter, the matter underwent several adjournments. On 01.08.2018, a request was made by the learned counsel for the petitioner for an adjournment stating that he is unable to contact any of the executives of the petitioner. Acceding to the said request, the matter was adjourned to today. Today, learned counsel for the petitioner submits that in spite of his best efforts, there was no response from the petitioner and therefore, he has no other option except to report no instructions.

In view of the above submission, it is presumed that the petitioner is no longer interested in prosecuting the Company Petition.

Accordingly, the Company Petition is dismissed. It is made clear that the dismissal of the Company Petition shall not be
