THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1953 of 2014 ORDER:

This Contempt Case is filed alleging non-implementation of the common order passed in W.P.Nos.5688 and 20370 of 2010 dated 17.09.2013. The said writ petitions were filed seeking a direction to declare the appointments of the petitioners as valid and for release of grant-in-aid. The writ petitions were allowed by directing respondent Nos.1 to 4 to consider granting approval to the selections of the petitioners in the school of the fifth respondent disregarding the objections raised by the Regional Joint Director and the objections of the Commissioner; the Director of School Education; and the Government. 2.

In pursuance of the said direction, the Regional Joint Director of School Education, Warangal, passed orders in RC.No.5113/A2/B1/2013 dated 10.01.2014 implementing the direction and the relevant portion of the said order reads as follows:

"In view of the Hon'ble AP High Court orders dt.17.09.23013 and as per orders of the Commissioner and Director of School Education, AP Hyderabad vide reference 15th cited the Regional Joint Director of School Education, Warangal is pleased to approve the selections made by the management of Sri Rama Chandra Educational Institution Kothagudem as detailed below in terms of Rule 12(8) of G.O.Ms.No.01/Edn, dt.01-01-94.

3. Now the Correspondent of the fifth respondent School is requested to issue appointment orders in accordance with the said approval and submit the proposal for approval of the appointment

orders.

The learned counsel for the petitioner submits that no approval was accorded for the appointment orders, whereas the learned Government Pleader submits that the School itself is not sending the proposals.

The issue relating to appointments is beyond the scope of the writ petition and in any event, the Regional Joint Director of School Education, Warangal, passed an order implementing the common order passed by this Court on 17.09.2013. In view of this, this Court sees no violation of the order passed by this Court. The Contempt Case is accordingly dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
