HONOURABLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1746 of 2015 ORDER:

The Contempt Case is filed alleging non-compliance of the order of this Court in WPMP.No.17142 of 2015 in W.P.No.13038 of 2015 dated 29.04.2015.

The operative portion of the order reads as under: "In the light of the above plea of the petitioner, I am of the prima facie opinion that unless an order is passed on the petitioner's explanation in pursuance of notice dated 07.07.2009 by respondent No.3, the petitioner cannot be evicted. Hence, I find the elements of balance of convenience and irreparable injury in favour of the petitioner". A specific counter affidavit is filed by the Chief Executive Officer of the A.P. Wakf Board categorically stating that they are not interfering with the subject land admeasuring Ac.0.661⁄2 cents in Sy.No.62 situated at Kurnool, and shall also not interfere with the petitioner's possession.
