This Writ Petition, under Article 226 of the Constitution of India, is filed seeking issuance of writ of mandamus declaring the action of the first respondent in passing order dated 08.12.2009 in Civil Miscellaneous Appeal No.25 of 2006, as arbitrary, illegal and contrary to provisions of Sections 52, 53 and 55 of the A.P.H.B. Act, 1956, and consequently, to set aside the same. 2.
At the time when the matter is taken up for hearing, learned counsel for the petitioner submits that the cause in the writ petition does not survives for adjudication and the petition has become infructuous.

Recording the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C.
