THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.29416 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned standing counsel appearing for the respondents/ APEPDCL. The petitioner claims to be absolute owner of the house bearing No.26-2-3 situated at R.R. Road, Kalika lane at Kakinada in East Godavari District. The petitioner is having electricity service connection bearing SC No.A1330 and the said connection was in the name of one V. Subbamma (G.V. Subbamma), who expired in the year 1978. The said property was purchased through the legal heirs of the said Subbamma by the petitioner. While so, the fourth respondent issued a provisional assessment notice on 09.09.2000 directing the petitioner to pay an amount of Rs.1,07,040/- and the same was confirmed by the third respondent, through proceedings dated 12.03.2001 directing the petitioner to pay an amount of Rs.1,02,359/-.

Though the order was passed on 12.03.2001, it was communicated only on 11.09.2007. Since the appeal lies against the said order of the third respondent to the second respondent, the petitioner preferred an appeal before the second respondent on 05.10.2007 and the same was acknowledged by the second respondent on 10.10.2007 and when no orders have been passed on the said appeal till today, the present writ petition is filed. When the matter came up for consideration on 10.09.2015, it was adjourned in order to enable the standing counsel for the respondents/APEPDCL to get instructions. Even after one week, the learned standing counsel did not get any instructions.

the petitioner against the order passed by the third respondent dated 12.03.2001 as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order. It is needless to mention that disposal of the appeal by the second respondent shall be in accordance with law after giving due opportunity to the petitioner.
