THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16230 OF 2017 O R D E R :

This Writ Petition has been filed to declare the action of the 2nd respondent Municipality in not issuing Ownership Certificate and not providing water connection and drainage connection for hotel purpose and for construction of staircase for fire safety and not taking any action on the representation for closure of upper portion of the open drain to a length of 25 feet and width of 4 1⁄2 feet in respect of Door No. 12-2-676 situated at Christian Palem, Main Road, Macherla, Guntur District, as illegal and contrary to the Order dated 02.12.2016 in Writ Petition No. 41968 of 2016. One of the complaints in the Writ Petition is that the petitioner, pursuant to the Order dated 02.12.2016 passed by this Court in Writ Petition No. 41968 of 2016, has submitted the representations to the authorities concerned, questioning the determination of tax, raising various grounds, but so far, no orders have been passed thereon.

Heard learned counsel for the petitioner Smt. A. Chaya Devi. Sri Nimmagadda Venkateswarlu, learned Standing Counsel for the 2nd respondent Municipality asserts that as a matter of fact, a demand was raised on the petitioner for a sum of Rs.14,14,957/- consisting of principal and interest, but she has not paid the same. He also asserts that the Revision filed by the petitioner has already been disposed of and the order was dispatched to her address, but it was returned. The said Order has become final. He further submits that the petitioner has a remedy to avail under the Andhra

Pradesh Municipalities Act, 1965 and the Rules made thereunder against the Order in the revision.

In that view of the matter and also considering the fact that the petitioner asserts that the Order in Revision has not been served on her, the Writ Petition is disposed of directing the respondent Municipality to dispatch a copy of the Order through Registered Post, to the address mentioned by the petitioner in the Writ Petition, with a copy marked to the learned counsel for the petitioner Smt. A. Chaya Devi, H.No. 13-6-429/1/A/29, Balaji Nagar, Near Gudimalkapur Market, Hyderabad-06. As and when the Order is served, if she has any subsisting grievance, the petitioner shall be at liberty to exercise her rights in accordance with the Act and the Rules. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
