No. 201, admeasuring Ac.

HON'BLE SRI JUSTICE K.LAKSHMAN WRIT PETITION No.4345 of 2023 ORDER:
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Petitioner herein is claiming that he is absolute owner and possessor of land admeasuring Ac.3-00 gts in Sy.No.20llA and Ac.2-09 gts in Sy.No.20llAA, total admeasuring Ac.5-09 gts, situated at Govindahalli Shivar of Dantanur Grampanchayat, Kothakota Mandal, Wanaparthy District, on the strength of a registered sale deed bearing document No.l847 of 2005 dated 06.04.2005. He is also owner of land in other survey numbers of the very same village. In proof of the same, he has filed copies of aforesaid sale deed and old Pattadar passbook. The aforesaid land admeasuring Ac.5-09 gts is mentioned in prohibited list. Therefore, he had submitted online application vide Id No.22T359400000623 dated 28.06.2022 with the 2nd respondent with a request to delete the aforesaid property from the prohibited list. Despite receiving and acknowledging the said online application, 2nd respondent did rb \., not act upon the same. Therefore, the present Writ Petition. /

Whereas, the learned Assistant Government Pleader for Revenue, on instructions would submit that the 2nd respondent will consider the said online application submitted by the petitioner and pass appropriate orders in accordance with law.

In view of the said discussion, this Writ Petition is disposed of directing the 2nd respondent to consider the online application vide Id No.22T359400000623 dated 28'06'2022 submitted by the petitioner and pass appropriate orders in accordance with law by putting the petitioner and all effected parties on notice and affording them an opportunity' The 2nd respondent shall also consider the instructions issued by Chief Secretary and CCLA's Ref'No.CMRO/369112022 dated 03.11.2022, If, 2nd respondent is not inclined to accept the request made by the petitioner, he shall assign specific reasons and pass a reasoned order, communicate copy of the said order to the petitioner and complete the said exercise within a period of eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
