The Court made the following:

ORDER:

This Contempt Case is filed alleging wilful disobedience of order dated 3-12-2015 in W.P.No.39343 of 2015.

The petitioner herein filed the above mentioned Writ Petition with the grievance that the complaint filed by him against an Advocate was not being considered by the Bar Council of Andhra Pradesh. This Court has disposed of the said Writ Petition by order dated 3-12-2015 by placing on record the undertaking given by the State Bar Council to the effect that the Advocate against whom the petitioner gave complaint has already submitted her comments and the same will be discussed and a decision whether to refer the complaint to the disciplinary committee or not will be taken in the ensuing General Body Meeting of the respondent scheduled to be held on 19/20th December, 2015. Alleging that the said order has been violated, the petitioner filed the present Contempt Case.

At the hearing, the petitioner who has appeared in person submitted that till now the State Bar Council has not

taken a decision on his complaint and communicated the same to him.

Mr. G.M. Mohiuddin, the learned Standing Counsel for the respondent-State Bar Council, placed before the Court order dated 29-12-2015 in W.A.No.1136 of 2015 filed by the petitioner against the order in W.P.No.39343 of 2015 out of which the present Contempt Case arises, a perusal of which shows that the Division Bench has taken note of the fact that the petitioner's complaint was considered by the General Body of the State Bar Council and dismissed the same as it did not find prima facie case against the Advocate and in view of the said fact the Division Bench has dismissed the Writ Appeal as infructuous.

At the hearing, the petitioner has admitted that he has knowledge of the above mentioned order passed by the Division Bench.

Inasmuch as the General Body of the respondentState Bar Council has already taken a decision as undertaken by its Counsel before this Court in W.P.No39343 of 2015, whereby it has rejected the petitioner's complaint, the plea of the petitioner that the Bar Council has violated the order of this Court in the said Writ Petition is wholly misconceived and hence the Contempt Case is dismissed.
