THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21389 of 2017 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to direct the 1st respondent to take on file and dispose of the Revision filed by the writ petitioner on 27.06.2017 expeditiously and till Revision is disposed of by the 1st respondent, direct the 3rd respondent not to dispossess the writ petitioner from the shop at Nagulaputta (Vasanthamandapam) by setting aside the proceedings of 3rd respondent in Rc.No.C2/1644/2017, dated 18.06.2017.

When the matter is taken up for hearing, it is informed by the learned Standing Counsel for the 3rd respondent informed that the possession of the subject premises has already been taken by the 3rd respondent pursuant to the orders, dated 17.04.2017, passed by this Court in W.P.No.12698 of 2017 and that the petitioner has also submitted an undertaking to that extent to the 3rd respondent.

Having regard to the said submissions, the cause in the writ petition does not survive and the writ petition becomes infructuous.

4. Accordingly, the Writ Petition is dismissed as infructuous. The petitioner is at liberty to avail appropriate remedies available to him under law. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
