THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5524 OF 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a writ order or direction especially one in the nature of writ of mandamus declaring that a) the action of the respondents in not considering the case of the petitioner for transferring him from Guntur to Zone-I (Srikakulam, Visakhapatnam & Vizianagaram District) as illegal and arbitrary violating of Article 16 of the Constitution of India. b) the action of the respondents in not considering and passing appropriate orders on the representation of the petitioners dated:03-12-2015 which was forwarded by the 3rd respondent to the 2nd respondent on 14.12.2015 is illegal and arbitrary. c) Petitioner is entitled to the transferred to any of the 3 Districts in Zone-I viz., Srikakulam, Visakhapatnam & Vizianagaram Districts. d) and pass such order or orders as this Hon'ble Court may deemed fit and proper in the circumstances of the case."
2. Heard Sri M.Srinivas Rao, learned counsel, appearing for the petitioner; learned Government Pleader for Housing, appearing for respondent no.1 and Sri J.Sudhakar Reddy, learned standing counsel for the respondents 2 and 3, appearing for the respondents.
3. It is reported by learned counsel for the petitioner that the petitioner herein submitted a representation through the Projector Director, A.P. State Housing Corporation Limited, Guntur3rd respondent herein and the 3rd respondent forwarded the same vide Rc.No.1930/2015-H2, dated 14.12.2015, to the 2nd respondent and the said representation is pending before the 2nd respondent and the same may be directed to be disposed of, as per law, by fixing some timeframe. The said request is not opposed by the
other side.
5. For the aforesaid reasons, Writ Petition is disposed of, directing the 2nd respondent - Managing Director, A.P.State Housing Corporation Limited, to take appropriation action pursuant to the letter bearing Rc.No.1930/2015-H2, dated 14.12.2015, of the Project Director, Guntur, within a period of three weeks from the date of receipt of a copy of this order.
6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 22.02.2016 SS
