CVNR,J & MSKJ,J C.M.A.No.634 of 2017 13.07.2017 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) Feeling aggrieved by non-granting of ad interim injunction in the pending partition suit, the plaintiff filed this appeal. 2.

At the hearing, Mr.Ch.Venkat Raman, learned counsel for the appellant, has submitted that the respondent has already filed a counter-affidavit before the Court below and that his client will be satisfied if a direction is issued to the Court below to dispose the application filed seeking ad interim injunction expeditiously.

In the light of the above submission of the learned counsel for the appellant, the Civil Miscellaneous Appeal is disposed of with the direction to learned II Additional District Judge, Vijayawada, to dispose of I.A.No.1129 of 2016 in O.S.No.330 of 2016 within a period of two months from the date of receipt of a copy of this order. 4.

As a sequel to disposal of the appeal, C.M.A.M.P.No.1041 of 2017 filed by the appellant for interim relief shall stand disposed of as infructuous.
