THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3570 of 2018 ORDER:

In spite of granting time on 06.02.2018, learned Government for Revenue appearing for the respondents did not get any instructions, therefore, this Court is constrained to dispose of the Writ Petition on the basis of averments made in the affidavit filed in support of the petition.

It is the case of the first petitioner that her husband orally partitioned the ancestral properties with his father and brother. Pursuant to the said partition, her husband became the absolute owner and possessor of various properties. Thereafter, her husband executed an unregistered Will Deed, dated 07.02.2016, during his life time bequeathing the properties in favour of the petitioners. Her husband passed away on 26.07.2016. Thereafter, the petitioners submitted an application on 12.12.2017 to the second respondent for mutation of their names in the revenue records and when no action was taken pursuant to the said application, the present Writ Petition is filed.

In view of the application filed by the petitioners in Form 6 (A) on payment of required amount on 12.12.2017, the second respondent is directed to consider the said application and pass appropriate orders thereon, in accordance with law, within a period of four (04) weeks from the date of receipt of a copy of this order. 4.
