THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Appeal No.342 of 2010 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The grievance of the appellant is that, despite his explanation to the show cause notice dated 18.11.2009 having been submitted on 02.12.2009, no orders were being passed. The Learned Single Judge, in the order under appeal, relegated the appellant-writ petitioner to the remedy of a statutory appeal. By way of an interim order dated 05.05.2010, the Division Bench directed the 1st respondent to pass orders pursuant to the explanation submitted by the appellant-writ petitioner on 02.12.2009, after giving him a reasonable opportunity, within four weeks from the date of receipt of a copy of the order.

The Division Bench did not interfere with the order of suspension. Sri K.Venu Madhav, learned counsel for the appellant-writ petitioner, states that in the light of the aforesaid order of the Division Bench dated 05.05.2010, no further orders need be passed in the writ appeal and the cause in the writ appeal does not survive.

The Writ Appeal is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
