HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO TRANSFER C.M.P. No.547 of 2017 ORDER :

Heard both sides at length.

One is complaining threat to the life at Visakhapatnam and Srikakulam their respective native places. So far as the petition for the divorce averment at para (h), the transfer petition respondent made an allegation about the attack at Srikakulam and giving of police report and therefrom referring a threat of fresh attack if he attends the Court at Srikakulam of the petition filed at Visakhapatnam, which is his native place.

By considering the rival contentions to sub-serve the ends of justice, this Court chooses to transfer to Family Court, Vizianagaram, with a direction to the main O.P. petitioner/husband to pay at Rs.200/- per every adjournment towards transport charges to the wife. The trial Court shall not insist the personal appearance if representing through advocate appointed under Section 13 of the Family Courts Act, if any, but for reconciliation and giving of evidence of both parties respectively.

With the above conditions and directions, the transfer C.M.P. is allowed.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
