THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36773 of 2012 ORDER:

The grievance of the petitioners was as regards registration of Crime No.103 of 2012 against petitioner Nos.2 to 14 under Sections 3 and 4 of the Andhra Pradesh Gaming Act, 1974 (for brevity 'the Act of 1974'). Their complaint was that the provisions of Section 5 of the Act of 1974 were not complied with and contrary to the order passed by this Court in W.P.No.414 of 2012, the crime was registered. No interim orders were granted by this Court in this writ petition. It is now stated by the learned Assistant Government Pleader for Home, relying on the written instructions dated 01.07.2015 received from the Sub-Inspector of Police, Gudur I Town Police Station, Nellore District, that Crime No.

103 of 2012 was registered under Sections 3 and 4 of the Act of 1974 upon seizure of playing cards from the 1st petitioner - Club wherein gambling activity in connection with the card game 'kothamukka' was going on. Further, upon due investigation of the crime, the police authorities laid a charge sheet vide C.C.No.481 of 2012 before the learned Additional Judicial Magistrate of First Class, Gudur. The case was stated to be pending trial. In the light of the aforestated developments, it is for the petitioners to face the proceedings before the competent criminal Court. No interference is called for in this writ petition at this late stage. The writ petition is therefore dismissed leaving it open to the petitioners to take recourse to appropriate remedies in accordance with law in future, if warranted.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
