THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.1155 of 2017 ORDER:

Petitioner challenges notice issued under Section 115(1) of the Andhra Pradesh Capital Region Development Authority Act (for short 'the Act') directing him to submit explanation with regard to his alleged illegal construction, and notice issued under Section 116 of the Act with reference to the stoppage of further construction.

Both the notices impugned in the present Writ Petition deal with independent issues. Admittedly, petitioner has not submitted his explanation. No justifiable cause is shown by petitioner for his filing Writ Petition without submitting explanation. Learned counsel for petitioner submits that petitioner would submit his explanation on 09.01.2017.

If petitioner submits his explanation on 09.01.2017, the authority concerned shall consider the same and pass appropriate orders as warranted under law, and if such explanation is submitted by petitioner, no coercive action shall be taken against him till final orders are passed. Petitioner is also directed not to

undertake construction till a decision is taken as a consequence to the notice issued under Section 115(1) of the Act. Writ Petition is accordingly disposed of.

Pending miscellaneous applications, if any, shall stand closed in consequence.
