ORDER

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.1 to 4 in Crime No.26 of 2026 before the Ramkarishnapur Police Station, Ramagundam District, registered for the offence punishable under Sections

126(2), 292, 115(2) r/w. 3(5) of BNS, 3(1)(r)(s), 3(2)(va) of SC/ST (POA) Act.

The brief facts of the case are that on 30.01.2026 at about 20:30 hours at Gadderagadi Village of Mandamarri Mandal and was reported on 02.02.2026 at 18:00 hours. The defacto complainant, who had taken a loan of Rs.70,000/- from Bajaj Finance Company, Mancherial, was unable to pay the EMIs due to ill health. When accused No.1 demanded repayment, she requested one month's time. Subsequently, while proceeding from Gadderagadi to Mancherial, accused No.1 along with his father (A2), mother (A3), and sister (A4) allegedly obstructed her, abused her in filthy language referring to her caste name and assaulted her with hands.

Mangulal, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the complaint is a false and concocted one, filed with the sole intention of harassing the petitioners and avoiding repayment of EMIs. He further submitted that the petitioners No.1 and 4 are employees of Bajaj Finance Company, and the dispute is purely financial in nature. He asserted that petitioners No.2 and 3, being parents of petitioners No.1 and 4, have no connection whatsoever with the financial transaction, yet their names were unnecessarily included to drag them into litigation. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition. 5.

Learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners, and contended that there are serious allegations against the petitioners and investigation is pending. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions and material on record, it is noted that the prime allegation against the petitioners is that they abused complainant in filthy language in the name of caste, whereas, it is the specific contention of learned counsel for petitioners that the EMI statement is filed which would show that the complainant has not paid EMIs from the month of September. Though de facto complainant submitted that EMI is not paid only for the month of January, the record shows that the same is pending from September. That apart, there is no such material on record to prove that petitioners and complainant know each other personally, so as to abuse in the name of caste. Therefore, this Court deems it fit to grant pre-arrest bail to the petitioners subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Ramakrishnapur Police Station, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on

executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
