THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3353 of 2016 ORDER:

This Criminal Petition is filed by the accused under Section 482 Cr.P.C., to quash the proceedings in Crime No.54 of 2015 on the file of II Town Police Station, Srikalahasthi registered for the offences under Sections 420, 465, 468 and 471 IPC.

Heard.

The ground on which the learned counsel for the petitioner seeks to quash the impugned proceedings is that there is inordinate delay in lodging the complaint. This Court is of the view that the delay is to be calculated from the date of knowledge of the offence. Further it is evident from the record that after due enquiry conducted by the competent authority, the present complaint is lodged. Hence, the sole ground of delay in lodging the complaint is not a ground to curtail the investigation at the threshold and the Criminal Petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
