THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON NO.4259 of 2019 ORDER:

The prayer of the petitioners in this case reads as under; "It is humbly prayed that this Hon'ble Court may be pleased to:

(1) issue a writ, order or direction, more particularly one in the nature of a mandamus declaring the inaction of the 3rd respondent in updating the record of rights maintained under the Telangana Rights in Land and Pattadar Pass Books Act 1971, for the years 2018 and 2019 by duly continuing the petitioners' names therein, in respect of land admeasuring Acs.25.00 gts in Sy.No.77 & 78 of Sirigiripur Village, Maheshwaram Mandal, Rangareddy District and also in not issuing the pattadar pass books and title deeds in the new revised format to the petitioners in respect of the said land, as being arbitrary, illegal, unconstitutional, without jurisdiction and in violation of Articles 14,19,21 and 300-A of the Constitution of India and the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 and the Rules framed thereunder, and

(2) consequently, to direct the respondents to forthwith update the record of rights for the years 2018 and 2019 by duly continuing the petitioners' names therein and to issue pattadar pass books and title deeds in the new revised format to the petitioners in respect of the said land and pass any other order or orders at this Hon'ble Court deems fit in the facts and circumstances of the case".

Perusal of the record reflects that the petitioners were already issued regular pattadar pass books and title deeds under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. Their complaint presently is that the revenue authorities are not updating their names in the land records and issuing them new pattadar pass books.

SK, J W.P.No.4259 of 2019 It appears that the petitioners have already addressed written representation dated 11.01.2019 to the Mandal Revenue Officer, Maheshwaram Mandal, Ranga Reddy District. Perusal of the said representation demonstrates that the office of the Tahsildar, Maheshwaram Mandal, received it on the very same day. By way of the said representation, the petitioners asked the Tahsildar to provide them updated revenue records/pahanies in respect of the subject land and also issue them new pattadar pass books and title deeds in relation thereto.

Having received such a representation, it is not open to the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, to remain somnolent.

The Writ Petition is accordingly disposed of directing the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, to take appropriate action upon the petitioners'

representation dated 11.01.2019 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs. ______________ SANJAY KUMAR, J 1st March, 2019 sj
