THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13365 OF 2014 ORDER:
1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner/A.2 in C.C.No.220 of 2014 on the file of the Court of the IV Additional Judicial Magistrate of First Class, Tirupati, Chittoor District. 2 At the time of arguments, the learned counsel for the petitioner has sought permission of the Court to permit the petitioner to withdraw this Criminal Petition, with liberty to avail the remedies available to her under law. He further requested that the presence of the petitioner/A.2 before the trial Court may be dispensed with on each and every date of adjournment. 3 The petitioner herein is none other than the mother of the accused No.1 and aged about 54 years. There is no dispute with the regard to the identity of the petitioner, who is accused No.2 in the case.
Even if her presence is dispensed with, no prejudice will be caused to the 2nd respondent. 4 In the result, the Criminal petition is dismissed, granting the liberty as prayed for. The presence of the petitioner, who is accused No.2 in C.C.No.220 of 2014 on the file of the Court of the IV Additional Judicial Magistrate of First Class, Tirupati, Chittoor District is dispensed with on each and every dated of adjournment. However, she shall appear before the trial Court as and when her presence is so required.
