THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1431 of 2020 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A2, seeking to grant anticipatory bail to him in Cr.No.32 of 2020 on the file of Ameenpur Police Station, Sangareddy District, registered for the offences under Sections 509 IPC and under Section 11(ii), 15, 22, 23 of POCSO Act, 2012 and Section 74, 75,79 of J.J.Act and Section 3A, 14 of Child Labour Act, 2016, against him.

Heard learned counsel for the petitioner/A2, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the complaint that on 23.01.2020 at 9.30 AM., the daughter of complainant, by name Kumari Puli Pavani, aged 16 years, went to shop to bring milk packet, but she did not return to home and her mobile was switched off, and at about 2.30 PM., her daughter attended phone call and told that one person forcibly took her in a car in which two other inmates were there and those three persons dragged her into bushes and raped her one by one and they went away from that place leaving her. 4.
Learned counsel for the petitioner/A2 submits that the allegations leveled against the petitioner/A2 are all false, frivolous and concocted and that the petitioner never engaged the daughter of the complainant as labourer and a false complaint is filed against
him due to political rivalry to damage his reputation. He further submits that the petitioner has not committed any offence as alleged by the prosecution. He further submits that the entire investigation is completed, except filing of charge sheet. He also submits that the petitioner/A2 hails from a respectable family and he shall abide by any condition imposed by this Court.

Learned Additional Public Prosecutor opposed the relief sought in the petition.

As seen from the contents of the remand report, there are specific allegations against the petitioner/A2 that he engaged a minor girl as servant activist to canvass his party along with A1 as wife of A2 contested in Municipal Elections and that when the victim was in desperate state of mind with clothes disarrayed, A2 recorded her video disclosing her name and identity and shared the video to social media. Thus, in view of the nature of allegations leveled against the petitioner/A2 and other facts and circumstances, I am not inclined to grant anticipatory bail to him and his prayer for anticipatory bail is refused. However, if the petitioner/A2 surrenders before the trial Court within 15 days from today and files an application for bail, the trial Court may consider the same in accordance with law.

With the above directions, the Criminal Petition is dismissed. 8.
Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
